本票裁定要抗告的話?

我是執票人

前一陣子發票人因賭博欠幾萬元

跟我簽定本票!

我當然知道在法律上賭博是犯法(賭債非債)

但是我拿現金 他輸到萬元簽本票

憑甚麼會有不還的心態- -" (又沒逼人賭博)

發票人有簽名 (簽名.大寫金額.阿拉伯數字金額這三個地方有蓋手印)

現在問題是 假設我到法院裁定本票時

發票人在期限內抗告 他會說債權不存在嗎??(賭債)

這時是發票人要提出債權不存在的證據?

還是我必須要拿出本票存在的證據?

本票不是無因債卷嗎....?
