公告事項

按民法第1059條第1項至第3項規定：「父母於子女出生登記前，應以書面約定子女從父姓或母姓。未約定或約定不成者，於戶政事務所抽籤決定之。(第1項)子女經出生登記後，於未成年前，得由父母以書面約定變更為父姓或母姓。(第2項)子女已成年者，得變更為父姓或母姓。(第3項)」又按戶籍法第49條第1項規定：「出生登記當事人之姓氏，依相關法律規定未能確定時，婚生子女，由申請人於戶政事務所抽籤決定依父姓或母姓登記……。」

鑑於民法96年5月23日修正後，子女從姓規定有重大變革，由原則從父姓，改為得從父姓或母姓。自96年5月23日民法修正後至102年5月31日止，父母約定子女從姓案件共1,147,448件，從父姓1,129,095件，占98.4%，從母姓18,238件，占1.59%，原住民傳統姓名115件，占0.01%，子女從父姓與從母姓之比例仍相當懸殊。
